Terms of Service

These Terms of Service ("Terms") are a contract between you and Liam Nelson, a sole proprietor doing business as hablio.cc in Oregon ("hablio.cc", "we", "us"). They apply to the website at hablio.cc and everything on it (the "Service"). Please read them together with our Privacy Policy.

1. Acceptance and eligibility

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 13 years old to create an account. hablio.cc is not directed to children under 13, and we do not allow them to register. We do not offer a parental-consent route for children under 13. If you are 13 or older but under the age of majority where you live (18 in most places), you may use the Service only with the permission of a parent or guardian, who is also bound by these Terms. If we learn that someone under 13 has an account, we will delete it.

2. The service

hablio.cc is an educational website that helps people learn Spanish through lessons, games, Hablio Hangout, friends and private messaging, and an AI tutor named Lola. Some features are still being built and may change or be removed at any time. Learning a language takes time and practice. We do not promise that you will become fluent or reach any particular level, score, or result.

3. Accounts and security

• You must give accurate information, including a working email address that you control. We ask you to confirm it through a link we email you.
• Your username and profile are shown to other signed-in users while your profile is public. You can make your profile private in profile settings. Do not choose a username that is offensive, impersonates someone, or infringes anyone's rights.
• You are responsible for keeping your password secret and for everything that happens under your account. Tell us right away at [email protected] if you think someone else has used it.
• One person, one account. Do not sell, share, or transfer your account.

4. Acceptable use

You agree not to:

• break the law or use the Service to harass, threaten, bully, or harm anyone;
• upload or share anything unlawful, hateful, sexually explicit, violent, or that infringes someone else's rights, including profile pictures;
• use Hablio Hangout to harass, solicit, exchange personal contact details, share links, or send sexual or hateful content. Chat filters may miss content or mistakenly block a message; use the report and skip controls and do not share private information;
• use friend requests or private messages to spam, harass, threaten, solicit, or otherwise harm another user;
• pretend to be another person, or collect other users' personal information;
• try to gain unauthorized access to the Service, other accounts, or our systems, or probe, scan, or test them for weaknesses;
• interfere with or overload the Service, or use bots, scrapers, or automated tools to access it (other than ordinary search engines);
• upload malware or other harmful code;
• try to trick Lola into producing harmful content, or use her output to harm others;
• copy, resell, or build a competing product from our content, except as these Terms allow; or
• create an account if you are under 13, or help someone under 13 to do so.

5. Our content and your license

The Service and its content, including lessons, text, audio, graphics, the hablio.cc name and logo, software, and design, belong to us or our licensors and are protected by copyright, trademark, and other laws. We keep all rights that we do not expressly give you.

While you follow these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service and view its content for your own non-commercial learning. You may not copy, distribute, modify, publicly display, or create derivative works from our content without our written permission.

6. Content you submit

You may give us a username, a profile picture, and messages typed to Lola or sent to friends ("Your Content"). You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, display, and process Your Content only as needed to run and improve the Service, for example showing your username and picture on your profile and to other signed-in users, and delivering your messages to the person you chose. This license ends when you delete the content or your account, except for copies in routine backups that are removed in the normal course.

You promise that you have the right to share Your Content and that it does not break these Terms. We may remove content that we reasonably believe does.

7. Lola, the AI tutor

Lola is an artificial-intelligence program. Her answers are generated automatically and can be wrong, incomplete, or out of date, including her translations and grammar explanations. She is not a human teacher and gives no professional advice. Check important information with a trusted source. Please do not tell Lola private information such as passwords, financial details, or health information.

8. Payments

The Service is currently free. We do not take payments, run subscriptions, or offer refunds. If we add paid features in the future, we will update these Terms and explain the prices, billing, cancellation, and refund rules before you pay.

9. Third-party links, services and ads

The Service may link to or depend on websites and services we do not control, such as Google, which we may use for optional sign-in, to send emails, and to show ads. We are not responsible for their content, practices, or terms, and your use of them is at your own risk. Advertisements, if shown, are provided by Google and do not mean we endorse the advertiser. 10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Service will be uninterrupted, secure, or error-free, or that the content (including Lola's answers) will be accurate. Some places do not allow these exclusions, so some may not apply to you.

11. Limitation of liability

To the fullest extent the law allows, hablio.cc and Liam Nelson will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnification

You agree to defend and reimburse us for claims, losses, and reasonable costs (including reasonable attorneys' fees) that come from your breach of these Terms, Your Content, or your misuse of the Service, to the extent the law allows.

13. Termination and suspension

You may stop using the Service at any time and may ask us to delete your account by emailing [email protected]. We may suspend or end your access, with or without notice, if we reasonably believe you broke these Terms, created risk or legal exposure, or if we discontinue the Service. Sections that by their nature should survive (such as ownership, disclaimers, limits of liability, indemnity, and governing law) will survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. Before filing a claim, please contact us at [email protected] and give us 30 days to try to resolve the issue informally. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Clatsop County, Oregon, and you and we consent to those courts' jurisdiction and venue. If you are a consumer, you keep any rights under mandatory consumer-protection laws of the place where you live.

15. Changes to these terms

We may update these Terms from time to time. We will change the "Last updated" date above, and for material changes we will give notice by email to the address on your account or by a prominent notice on the site. Changes take effect on the date stated in the notice (and not before the notice is given). If you keep using the Service after that date, you accept the new Terms. If you do not agree, stop using the Service and ask us to delete your account.
